1. Agreement and eligibility
These Terms govern your use of PrintCommons. By creating an account, publishing content, requesting or providing fabrication services, placing an order, or otherwise using the marketplace, you agree to these Terms and the policies linked from them. You must be at least 18 years old and legally able to enter into a binding agreement.
2. What PrintCommons provides
PrintCommons provides marketplace software that helps users publish projects, discover fabricators, exchange messages and quotes, arrange fabrication, and facilitate payments. Unless PrintCommons expressly states otherwise for a particular service, fabricators are independent providers and are not employees, agents, partners, or representatives of PrintCommons. PrintCommons does not manufacture user orders and does not control a fabricator's shop, equipment, materials, or day-to-day work.
3. Accounts and truthful information
You are responsible for keeping your account secure and for activity performed through it. Information you provide about your identity, business, projects, machines, capabilities, materials, pricing, location, shipping, and availability must be accurate and not misleading. You may not impersonate another person or business, evade a suspension, or access another user's account without permission.
4. Marketplace transactions
Buyers and fabricators are responsible for confirming specifications, tolerances, materials, quantity, finish, price, taxes, timing, shipping or pickup terms, and any other material requirements before work begins. Quotes, project pages, messages, and order records may form part of the parties' transaction record. Changes to scope should be documented through PrintCommons before additional work or charges are accepted.
5. Fabricators
A fabricator must comply with the separate Fabricator Agreement. Among other things, fabricators are responsible for accurately describing equipment and capabilities, reviewing customer files, producing work safely and lawfully, meeting agreed specifications, communicating material changes, and fulfilling accepted orders.
6. Prohibited uses and products
You may not use PrintCommons for unlawful, fraudulent, deceptive, infringing, dangerous, or abusive activity. This includes using the marketplace to solicit, offer, manufacture, or distribute items whose manufacture, possession, shipment, or sale is unlawful; unlawful weapons or regulated weapon components; explosives; controlled substances; counterfeit or stolen goods; malicious devices; or products intended to defeat safety or access controls. PrintCommons may restrict additional categories when reasonably necessary for safety, legal compliance, payment-network requirements, or platform integrity.
7. Projects, files, and intellectual property
You retain ownership of content you submit. You grant PrintCommons a non-exclusive license to host, store, reproduce, transmit, display, resize, process, and otherwise use submitted content as reasonably necessary to operate, secure, and improve the service and to carry out transactions you request. You represent that you have the rights necessary to upload and authorize the requested use of your content. When you publish a project, you may be asked to expressly attest that you have the rights to upload, publish, license, and commercially authorize the files and content you submit. Project-specific licenses and commercial terms remain binding between the applicable users. See the Copyright Policy for infringement reporting.
8. Payments, fees, refunds, and taxes
PrintCommons may use third-party payment providers to process charges, payouts, refunds, disputes, and identity or risk checks. Applicable platform fees and transaction terms should be disclosed before a user incurs a charge. Users are responsible for taxes, registrations, licenses, and reporting obligations that apply to their own activity unless the law specifically requires PrintCommons or a payment provider to collect or remit them. Refunds, chargebacks, and order disputes may require review of the order record and user communications.
9. Shipping and local pickup
The fabricator is responsible for packaging and shipment obligations it accepts. Risk of loss, carrier claims, delivery timing, and pickup arrangements may depend on the agreed order terms and applicable law. Users should not disclose a private residential address publicly when a less precise location is sufficient.
10. Platform communications and circumvention
Users should keep transaction-related communications and payments on PrintCommons when the relationship originated through PrintCommons. You may not use the service primarily to obtain leads and then intentionally route transactions off-platform to avoid applicable marketplace fees or protections.
11. Moderation, suspension, and removal
PrintCommons may review, restrict, hide, remove, or preserve content and may limit or suspend accounts when reasonably necessary to enforce these Terms, investigate abuse, protect users, respond to legal requests, prevent fraud, or protect the service. We may preserve relevant records when required for disputes, security, fraud prevention, or law.
12. Service availability and changes
Features may change, be interrupted, or be discontinued. PrintCommons does not promise that every listing, user statement, machine specification, quote, file, or service will be accurate, available, compatible, safe, or suitable for a particular purpose.
13. Disclaimers
To the maximum extent permitted by law, PrintCommons and the marketplace are provided “as is” and “as available.” PrintCommons disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement to the extent those warranties may lawfully be disclaimed. Nothing in these Terms excludes a warranty or consumer right that cannot legally be waived.
14. Limitation of liability
To the maximum extent permitted by law, PrintCommons will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, loss of profits, business interruption, loss of data, or losses arising from the acts or omissions of another marketplace user. To the extent a monetary cap is permitted, PrintCommons' aggregate liability arising from the service will not exceed the greater of the fees you paid directly to PrintCommons during the 12 months before the event giving rise to the claim or $100. This section does not limit liability that cannot legally be limited.
15. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless PrintCommons and its operators from third-party claims, losses, liabilities, and reasonable costs arising from your content, your fabrication or sale of goods or services, your violation of another person's rights, or your material breach of these Terms. This obligation does not apply to the extent a claim was caused by PrintCommons' own unlawful conduct.
16. Privacy and cookies
Our Privacy Policy explains how personal information is handled. Our Cookie Policy explains the session, security, payment, and similar technologies used by the service.
17. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except to the extent another law gives you non-waivable rights. Nothing in these Terms prevents either party from seeking relief that cannot lawfully be limited by contract.
18. Electronic communications and acceptance
You consent to receive agreements, notices, disclosures, transaction records, and other communications electronically when the law permits. Checking a consent box, publishing a project, registering a machine, accepting a quote, or completing a payment can constitute an electronic signature or electronic acceptance when the interface clearly identifies the terms connected to that action. PrintCommons may retain timestamps and policy-version records as evidence of acceptance.
19. General contract terms
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later. You may not assign your account or these Terms without PrintCommons' consent, except where applicable law provides otherwise. PrintCommons may assign these Terms in connection with a reorganization, financing, merger, acquisition, or transfer of the service. These Terms, together with policies and transaction-specific terms expressly incorporated into them, form the agreement governing the service.
20. Changes and contact
We may update these Terms as the service changes. Material changes will be reflected by a new version and, when appropriate, additional notice or renewed acceptance.
